Public Offer

1. General Provisions

This document is a public offer: konkurenta.net (hereinafter the “Provider”) offers to enter into a service agreement on the terms set forth below with any person (hereinafter the “Client”).

The agreement is deemed concluded upon the Client’s registration in the dashboard at my.konkurenta.net and payment for the selected package (acceptance of the offer).

By using the konkurenta.net website without registration, you agree to Section 8 “Website Use.”

2. Definitions

  • Service — the konkurenta.net website, the dashboard at my.konkurenta.net, and the Provider’s software.
  • AI agent — a program that, based on the Client’s instructions, conducts voice dialogues, analyzes calls, and performs other functions described in the package.
  • Package — a set of features and service volumes with a price, published on the website or agreed upon individually.
  • Dashboard — the section of the Service where the Client selects a package, uploads data, launches campaigns, and receives results.

3. Subject of the Agreement

The Provider grants the Client access to the Service’s features within the scope of the paid package for the paid period, and the Client pays for the services and uses them in accordance with this agreement.

Package contents, prices, and limitations are published on the “Services” page and in the dashboard. Individual terms are formalized in a separate agreement.

4. Price and Payment

  • Services are paid in advance for a month or a year at the prices in effect at the time of payment.
  • Prices are listed in US dollars; prices in other currencies on the website are approximate and are converted at the exchange rate.
  • The service under the package begins after payment is received.
  • The refund procedure is described on the “Payment and Refund” page.

5. Rights and Obligations of the Provider

  • ensure the operation of the Service within the scope of the paid package, excluding scheduled maintenance and circumstances beyond its control;
  • maintain the confidentiality of the Client’s data and customer base and use them only for the provision of the service;
  • advise the Client on the use of the Service;
  • suspend the service if the Client violates Sections 6 and 7, notifying the Client thereof.

6. Rights and Obligations of the Client

  • provide accurate data upon registration;
  • upload only those contacts for which the Client has legal grounds for calling and processing (subscriber consent, etc.);
  • be solely responsible for the content of dialogue scripts and compliance with laws on advertising, telemarketing, and data protection in the countries where calls are made;
  • not grant access to the dashboard to third parties.

7. Prohibited Use

It is prohibited to use the Service for fraud, threats, distribution of illegal content, calling numbers on do-not-call lists, impersonating another person without their consent, or for any actions that violate the law.

8. Website Use

  • Website materials (texts, images, design) are protected by copyright; copying without the Provider’s consent is prohibited, except for quotation with a link to konkurenta.net.
  • Responses from the AI assistant in the chat are for informational purposes only and do not constitute an offer; only terms confirmed by a manager or formalized in the dashboard are binding.
  • Links to third-party websites are provided for convenience; the Provider is not responsible for their content.

9. Liability

  • The Service is provided “as is.” The Provider does not guarantee a specific commercial result for the Client’s campaigns.
  • The Provider’s liability is limited to the amount paid by the Client for the current period.
  • The Provider is not liable for losses caused by the actions of telecommunications operators, failures of third-party services, or force majeure circumstances.

10. Personal Data

The processing of personal data is described in the Privacy Policy. With respect to contacts uploaded by the Client, the Client acts as the data controller, and the Provider processes them on behalf of the Client and solely for the provision of the service.

11. Term, Modification, and Termination

  • The agreement is in effect for the paid period and is renewed upon the next payment.
  • The Client may cancel the services at any time by ceasing payment; refunds are made according to the rules on the “Payment and Refund” page.
  • The Provider may change the terms of the offer by publishing a new revision; for an already paid period, the terms in effect at the time of payment apply.

12. Disputes and Details

Disputes are resolved through negotiations, and in the absence of an agreement, in a court at the location of the Provider in accordance with the legislation of Ukraine, unless otherwise provided by the mandatory norms of the consumer’s country.
